1. Purpose

This Legal Notice governs access to and use of the website paintawaytours.com (the "Website") and the responsibilities arising from the use of its content. The Website is owned and published by PAINT AWAY TOURS S.L. ("Paint Away Tours"). Through it, Paint Away Tours distributes tourism and creative products and services over the Internet, in particular plein air painting retreats in Europe; allows visitors to contact the company and request information; and enables the booking of trips and tourism services.

2. User status and acceptance

Accessing and browsing the Website confers the status of user and implies full acceptance of this Legal Notice from the moment of access. The user agrees to use the Website in accordance with the law, good faith and public order, and will be liable to Paint Away Tours or to third parties for any damage caused by improper use.

The booking of trips and services is also governed by the General Conditions and the Package Travel Contract, which the user must expressly accept before completing any booking.

3. Use of the Website

The user agrees not to:

a) Use the Website or its content for unlawful, fraudulent or unauthorized purposes.

b) Introduce or spread computer viruses or other systems or code that may damage or alter the Website or third-party equipment.

c) Attempt to access data, accounts or restricted areas without authorization, or alter their content.

d) Remove, circumvent or tamper with notices of intellectual or industrial property rights.

4. Third-party links

The Website may contain links to third-party pages (for example, those of the art instructors who lead our retreats, accommodations or social networks). Such links do not imply any relationship with those sites or endorsement of their content. Paint Away Tours is not responsible for their content, policies or practices.

The texts, photographs, images, logos, trademarks, design and structure of the Website, including the Paint Away Tours brand, are owned by PAINT AWAY TOURS S.L. or by third parties who have authorized their use, and are protected by Spanish and international intellectual and industrial property law. Their reproduction, distribution or public communication for commercial purposes without prior written authorization is prohibited.

6. Liability

Paint Away Tours does not guarantee the uninterrupted availability of the Website or that it will be free of errors, although it undertakes to correct them with the greatest possible diligence. Information on itineraries, accommodations, prices and dates is provided for information purposes and may be updated; the final terms of each trip are those set out in the package travel contract signed by the client. The foregoing is without prejudice to the rights that consumer law grants to travelers.

The processing of personal data is governed by our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD). The use of our own and third-party cookies is described in our Cookie Policy, in accordance with Article 22 of the LSSI-CE.

This Legal Notice is governed by Spanish law. For any dispute, the parties submit to the courts and tribunals with jurisdiction under the applicable regulations in force.
